The Department of Justice has sued Arizona, along with Connecticut and Illinois, to prevent states from enforcing their own gaming laws against prediction markets. Arizona's Attorney General, Kris Mayes, filed 20 criminal charges against Kalshi, alleging the prediction market is violating state gaming laws. The CFTC, which oversees prediction markets on the federal level, argues that state laws do not apply as prediction markets are governed by federal law. The DOJ argues that the CFTC is the sole authority to govern these markets and state gaming rules do not exist. Kalsh's attorneys have likened their platform to the Chicago Mercantile Exchange, where commodities such as corn, cattle, and oil are traded on futures contracts.
