In-state tuition for undocumented students could end under Nebraska-DOJ agreement

The U.S. Department of Justice (DOJ) has filed a complaint against Nebraska and filed a proposed consent decree to permanently prohibit the state from enforcing laws that require colleges and universities to provide in-state tuition rates to all immigrants who maintain Nebraska residency regardless of whether they are legally present in the U. The consent decree, which must be approved by the court, alleges that Nebraska's laws unconstitutionally discriminate against American citizens in favor of undocumented immigrants. The DOJ also seeks to enjoin Nebraska from enforcing state laws that provide financial assistance and scholarships to those with non-US citizenship. This is the eighth lawsuit filed by the DOJ to ensure that undocumented immigrants are not receiving taxpayer benefits or preferential treatment.
