Denver police fatally shot a man, 58-year-old Joseph Frank Martinez, who was carrying a BB gun when he was killed in a backyard in south Denver on April 7. The incident occurred after police officers responded to a 911 call about a man outside with a gun. Despite a family member initially suggesting the weapon might not be real or functional, officers were still dealing with a man carrying what appeared to be a rifle. The weapon was later determined to have been a pump-style BB rifle with a metal barrel. The shooting is being investigated by the Colorado Bureau of Investigation, the State Patrol, the Denver district attorney's office, and the police department's homicide unit.
