Fox News legal analyst Gregg Jarrett believes that the president may have a credible argument in denying automatic citizenship to children of parents who were here illegally. He argues that the 14th Amendment only applies to those fully under U.S. authority and that children born to parents living unlawfully in the country may not meet this requirement. He predicts some justices may side with Trump, citing the 1868 debates as evidence that Congress intended to secure citizenship for formerly enslaved people, not for children born of undocumented immigrant. The administration's challenge to nationwide blocks on the executive order was dismissed by lower courts in September and the Supreme Court agreed to review the case.
