Legislation giving Delaware people without homes more rights proves controversial

The bill sponsored by state Rep. Sophie Phillips, D-Bear, would expand the rights and protections of people without homes when using public spaces, such as sleeping or sitting outside. The bill would allow people experiencing homelessness to conduct life-sustaining activities in public, as long as they would not block traffic or an alternative indoor shelter is available. Some local governments oppose the legislation, arguing it could leave them liable for lawsuits. The cost of the bill is uncertain as it waives sovereign immunity for any civil rights lawsuit brought, which can be waived through legislation.
