Commentary: Congress must embrace sensible federal AI guidelines

This includes addressing the issue of 50 different sets of rules on AI development at the state level, which could hinder American technological progress and leadership. The White House issued a framework to govern AI on March 20, which includes preemption, a legal doctrine that federal law takes precedence over conflicting state laws. The framework also includes giving the National Institute of Standards and Technology a clearer role in determining AI modeling and stronger whistleblower protections for tech companies. To combat regulatory uncertainty, the U.S. needs AI preemption legislation, particularly regarding model development, to be enacted in 2026.
