German tourist, Faycal Manz, sued Los Tacos No. 1 in New York City for $100,000 in damages after he alleged that the restaurant sold salsa that he claimed was dangerously spicy. Manz claimed that he experienced gastrointestinal problems, high blood pressure, and emotional distress after eating the spicy salsa. However, a U.S. District Judge Dale Ho ruled against Manz, stating that spiciness is often the point of salsa. The judge stated that Manz failed to prove the restaurant acted negligently and did not provide evidence of other customers being injured by the salsa. Additionally, the judge also stated that the salsa is often spicy and that no one is responsible for injuries due to a consumer's personal preference for the type of salsa it is.
