The SECURE Data Act, introduced by Rep. John Joyce (R-PA) and House Energy and Commerce Committee Chair Brett Guthrie (RKY), would require companies to collect only the user data they really need, and require explicit opt-in for sensitive data. The bill also includes additional protections for data on teens aged 13 to 15, requiring parents' consent to process their information. However, it does not allow individuals to sue over alleged privacy violations and exempts pseudonymous data from certain protections, which some groups argue could create a loophole for targeted ads. Critics argue that the bill would allow the tech industry to continue collecting data and use it for marketing purposes. Business groups have praised the bill's preemption element, while others argue that it would create a confusing patchwork of consumers and small businesses.
