The Trump administration is running out of time to select a nominee for the CDC, as federal law stipulates that an acting director can serve for 210 days before the administration must present a nominee. However, Anne Joseph O'Connell, a law professor at Stanford University, believes this does apply. If a nominee is named, Bhattacharya can continue in the role while the confirmation process plays out. If not, the administration can delegate the role's "non-exclusive" duties to someone, likely to be Bhattacherarya. This would limit him to the position's "exclusive" role, which includes adopting or rejecting changes to the vaccine recommended by the CDC's panel of outside vaccine advisers. The NIH will no longer recognize a union of fellows at the agency, called the NIH Fellows United-UAW, under new rules.
