Despite being convicted in 1999 of kidnapping and molesting eight children, Funston was granted parole under California’s Elderly Parole Program, which allows inmates aged 50 or older who have served at least 20 years of continuous incarceration to be eligible for a parole hearing. Markson condemned California Gov. Gavin Newsom's soft-on-crime parole reforms, stating she was never notified of the court's decision. Despite recent admissions to having sexual fantasies about children while in prison, he still admits to being attracted to young girls.
