Empty-seat voting returns to the Assembly

The Assembly chamber will remain empty for the rest of the week, with over 70 percent of members of the Democratic majority typically skipping floor debates. This has led to significant legislation being deliberated before rows of empty chairs. The current attendance situation recalls the days of former Speaker Sheldon Silver when members could skip session and be counted as a "yes" vote on every bill. This change was removed in 2023 due to post-pandemic rules that no longer required members to be present and have their votes tallied. Republican floor leader Mary Beth Walsh argued that the highest-paid Legislature should be in their seats. The Assembly also conducted censuses of the chamber on 11 days since mid-March, tallying the members who were present at random moments when bills were being debated.
