Tough on crime prosecutors are targeting criminals who use California's mental health system as a "get out of jail free card". This comes after rapper Lil Nas X was placed into a mental health diversion program to avoid jail time for three felony charges of battery against a police officer and one for resisting arrest. Orange County DA Todd Spitzer is co-sponsoring a bill, AB 46, which would allow judges to deny diversion if the defendant poses an unreasonable risk to public safety. Spitzer argues that California's "mental health system is the definition of insanity" and that individuals seeking diversion are exploiting it for the purpose of addressing underlying issues of crime.
