Chicago White Sox legend Frank Thomas has filed a lawsuit against Nike, Nike, and Fanatics for the "unlawful" selling of jerseys bearing his name and number without his consent or compensation. The lawsuit alleges that these companies used his name, No. 35, and retired No. 2 for marketing and selling Chicago's "City Connect 2.0" jerseys without his permission, causing him to suffer economic detriment. The grounds for the lawsuit stem from the Illinois Right of Publicity Act, which prevents the use of an individual's identity for commercial purposes without their prior consent. The National Baseball Hall of Fame and Museum, Dick's Sporting Goods, and Other retailers may also be named as respondents in discovery.
