The New Mexico Supreme Court has ruled that the body camera confession of high school cheerleader Alexee Trevizo, who confessed to putting a newborn in the trash, cannot be used as evidence in her trial for the death of a newborn child. Despite prosecutors claiming that physician-patient privilege was waived because police and Treviziz's mother were present when a doctor asked her about the dead newborn, the court disagreed. The court stated that Trevizzo lacked the capacity to waive doctor-patient privileges due to her medical condition and had not been read her Miranda rights before making the statements to the doctor. The high school senior was arrested in May 2023 and charged with first-degree murder.
