Virginia Supreme Court reinstates Hampton murder conviction after Court of Appeals reversal

The Virginia Supreme Court has reinstated a murder conviction against Brian Latrell Fayne for killing his pregnant girlfriend outside a gas station in 2020. The conviction was overturned by the Virginia Court of Appeals last year due to police detectives' failure to honor Fayne's request for a lawyer. The court ruled that Fayne’s confession was legally valid because it came after he “reinitiated” the conversation with police an hour and 20 minutes later. The high court sided with the original trial judge, Hampton Circuit Court Judge Bonnie L. Jones, who ruled in April 2023 that prosecutors could use Fayne' confession against him at trial. However, Fayne attorney, James Broccoletti, argued that the court's opinion was erroneous and contradicts previous Supreme Court decisions. If it declines, Brocoletti will take the case to federal court.
