Justin J. Boseck, a licensed psychologist who practices and lives in Fargo, was arrested on suspicion of driving under the influence despite registering 0.00 on a roadside breathalyzer. Despite completing field sobriety testing and undergoing additional testing, the first test was deemed "probable" and the second, performed by a Drug Recognition Expert, was perfect and he documented no impairment. This arrest led to a six-week period of uncertainty, which left him feeling anxious and fearful. Despite this, Bosek's case was reviewed and resolved, he believes that constitutional protections like probable cause exist for a reason to protect ordinary people from government action. He also acknowledges the difficulty of law enforcement making good decisions under challenging circumstances.
