DOJ drops case against veteran arrested after burning American flag near White House

The Justice Department has moved to dismiss charges against veteran Jan "Jay" Carey for burning an American flag near the White House. The move follows an executive order by President Donald Trump to crack down on flag burning. Carey was arrested by U.S. Park Police in August after setting the flag alight on the same day as the executive order. He pleaded not guilty to two misdemeanors brought by Jeanine Pirro, the U-S. attorney for the District of Columbia. The decision to dismiss the case follows a ruling by a federal judge in January that would have led to further inquiries into whether the prosecution of Carey was influenced by the order. The Supreme Court ruled in 1989 that the Constitution protects flag burning, and the DOJ's move comes ahead of a Monday deadline in the case.
