ICE monitoring app takedowns violated the First Amendment

A court has ruled that the U.S. government cannot force Apple to remove ICE reporting apps from the App Store, citing this as a violation of the First Amendment. The Foundation for Individual Rights and Expression (FIRE) had sued the government over the right to report the activities of the Immigration and Customs Enforcement agency (ICE). The lawsuit focused on Eyes Up, an app that allowed users to post videos and details about ICE activity. In October 2025, Apple removed several similar apps, including ICEBlock, Red Dot, and Eyes Up. The court found that the Department of Homeland Security and Department of Justice had contacted Apple and Facebook rather than requesting an investigation. However, the court's preliminary injunction allows the plaintiffs to restore their work on their platforms.
