Judge Silver has refused to delay the takeover of Arizona's prison health system by state officials, stating that the state has failed to meet its obligations to provide adequate physical and mental health care. The state will still have to pay the $500,000-a-year salary of receiver Chambers-Smith, who was appointed for five years. This comes after Silver issued a 200-page list of problems in 2022, including inadequate physical and mentally health care and state officials' "deliberate indifference" to the risk of harm to inmates. Attorneys for Thornell have filed a notice seeking review from the 9th Circuit Court of Appeals. Silver dismissed arguments that the government has not been given enough time to fix the system, stating any harm to defendants (Thornell and the state) outweighs the harm caused by the ongoing unconstitutional provision of healthcare within Arizona's prisons.
