Judge rejects attempt to block law that restricts bathroom use, invalidates driver’s licenses

A Douglas County District Judge James McCabria has declined to halt enforcement of a new state law that restricts bathroom use for transgender residents and invalidates driver’s licenses. The law, which also criminalizes the use of bathrooms for cisgender women, was passed without public input and debate. The ACLU and Ballard Spahr represent two transgender men who argue it violates their constitutional rights to due process, privacy, equality and expression. McCabrian stated that he did not have enough information to support these claims and that Kansans are generally tolerant. The judge's decision allows plaintiffs to continue providing evidence and arguments in support of an injunction, pending a case management conference for March 18. The GOP-led Kansas Legislature fast-tracked Senate Bill 244, which took effect as soon as paperwork could be finalized.
