U.S. District Judge Brian Cogan in Brooklyn, New York, is reviewing a $38 billion swipe fee settlement between Visa and Mastercard. The settlement allows merchants to decline higher-cost cards, a departure from the "Honor All Cards" rule that requires merchants to accept all or not all of the card market. Critics argue that this would leave merchants with the choice between accepting the popular rewards cards or losing revenue. A previous $30 billion settlement was rejected in June 2024 due to antitrust violations.
