Nevada law gives sheriff power to block judge’s electronic monitoring release orders, case now before Supreme Court

The Nevada Supreme Court will decide if a sheriff can override a judge's order to release a defendant on electronic monitoring after he was arrested 36 times. The case involves Joshua Sanchez-Lopez, who was arrested for the 35th time and had been ordered on high-level electronic monitoring by Judge Eric Goodman nearly a month after his arrest. The sheriff, Kevin McMahill, filed an emergency motion to block the release and the judge found a workaround, a program monitored by the justice court. The authority to block a release order comes from two Nevada laws, which allow the sheriff to decide if electronic monitoring poses an unreasonable risk to public safety. Both parties are asking the Supreme Court to settle who has the authority.
