Oregon appeals court hands big victory to PacifiCorp in wildfire class action suit

The Oregon Court of Appeals has ruled in favor of PacifiCorp in a class action lawsuit stemming from Oregon's 2020 wildfires, effectively reversing $1 billion in damages. The court ruled that a judge in Multnomah County Circuit Court had instructed the jury to assume all evidence presented at trial about the causation and liability for all members of the class, which includes thousands of separate victims. The judges remanded the case back to the trial court and said the lower court has the authority to reconsider whether a single class of plaintiffs is appropriate in the case. The decision is a significant victory for Pacificor and its Oregon subsidiary, Pacific Power, which have raised the possibility of bankruptcy if the jury instructions and damage awards were allowed to stand.
