The administration has been inconsistent with its legal claims that it can detain people under an expansive view of ICE's power. Sometimes, the administration has missed deadlines and failed to respond to emergency lawsuits brought by the people ICE has detained, leading judges to rule in the detainees' favor. In some cases, it has simply agreed to provide a bond hearing or even release, stating officials have no opposition argument to present. This is part of a trend that has been seen in dozens of cases centered in California and Arizona.
