Alabama Governor Commutes Sentence of Murder Convict Who Never Killed Anyone 48 Hours Before His Execution

Alabama Governor Kay Ivey has decided to commute the death sentence of Sunny Burton, convicted of murder, who had fled the scene of the crime 48 hours before his execution but was not the actual murderer, but was the mastermind of the robbery of an AutoZone in 1991. Burton was set to be executed on March 12 using nitrogen gas to cut off oxygen to the body, a process unique to the state. This decision was announced by Ivey, marking her second commutation since she took office in 2017. Burton, now 75, was convicted of felony murder in 1992 and sentenced to death for his role in the robbery that killed a man. Derek DeBruce, the accomplice who shot a man dead, was also sentenced to life in prison in 2014 after successfully challenging his conviction on the grounds of ineffective counsel. Some of the same jurors who condemned Burton to death have publicly supported the effort to get him off death row.
