Tennessee lawmakers have passed a bill allowing the death penalty in some child rape cases, but a Supreme Court ruling could complicate the timeline for this legislation. The bill expands the number of aggravating circumstances prosecutors can use to pursue death sentences. These include aggravated rape of a child under four years old, a registered sex offender, a felony or misdemeanor conviction for sexual contact with a minor, and use of a deadly weapon in the commission of the offense. Hamilton County District Attorney Coty Wamp says these new aggravating factors mean death could only be sought out for the worst of the child rape crimes. The legislation is now headed to Gov. Bill Lee's desk, if it is approved, it would take effect July 1.
