The design of the coin has been approved by the Commission of Fine Arts and the Treasury Department hopes to begin production soon. However, Rickher argues that this violates federal law Title 31, which prohibits the inclusion of a living person on currency and securities. He argues that the coin would be considered legal tender and that the Treasury Secretary's discretion is limited.
