'I was young, immature': Killer seeks new sentence for 1994 murder of Sumner woman

Randy Philip Capps, a 52-year-old man serving life in prison without parole for the murder of 59 year old Mariette Dela Cruz in 1994, is seeking a reduced sentence for the crime. Capps was one of four people involved in the murder, along with Jason Lee Allison and Dokdinh Sayasack, who were both under the age of 21 when the murder was carried out. The Washington State Supreme Court recently ruled that youth should be considered when applying a life-without-parole sentence to defendants who are 18, 19, or 20 years old. This ruling allows offenders serving life-for-paroles in that age range to apply for resentencing. The Pierce County Prosecuting Attorney's Office is opposing Capps' release from prison. Cappapp has a Security Threat Group status in prison due to his affiliation with the Aryan Skin Kindred gang.
