New York Gov. Mary Hochul's plan to lower auto insurance premiums, which she claims will leave victim families with nothing, is seen as a plan that will revictimize families like mine and undermine accountability from wrongdoers. The proposal would allow for a jury to find a victim just 51% responsible for their negligence, leaving their family with nothing. This proposal is not substantively effective, as there is no credible evidence or estimate how these proposals will impact drivers' rates. The state already has the power to deny rate increases, impose penalties for excess profits of insurance companies, and use existing revenue from fees paid for drivers to investigate and prosecute fraud. The daughter of a state Transportation Department worker killed on the job argues that her father's case would not have been affected under these proposals.
