Convicted killer giggles in court as judge describes murder. Judge asks why he's laughing — and isn't amused by his answer.

Marcus Terry, a convicted killer who was convicted of second-degree murder for killing his cellmate at the Dade Correctional Institute in Florida, was caught on video smiling and giggling in court as the judge described the murder. The judge, Ellen Sue Venzer, questioned why he was laughing and was not amused by Terry's answer. Terry's attorney, Steven Yermish, had requested a new trial, claiming that inadmissible evidence made it into the December trial. Venzer rejected the request and continued with Terry's sentencing. The convicted killer was sentenced to life without parole and can appeal his sentence.
