The Justice Department has filed a lawsuit against New Jersey for allowing illegal immigrants to qualify for in-state tuition rates at public colleges, despite Americans living outside of New Jersey paying higher tuition. The Department of Justice argues that this violates federal law by granting illegal immigrants in state tuition, which is prohibited by Congress. The lawsuit also criticizes New Jersey's laws and regulations that discriminate in favor of illegal aliens over U.S. citizens from other states. The department is currently suing other states, including Illinois, Minnesota, Virginia, Nebraska, and California, for similar policies. The complaint argues that multiple rules should be wiped away and that all four New Jersey laws challenged are preempted and unconstitutional.
