Epic Games has successfully persuaded the US Court of Appeals for the Ninth Circuit to reverse a decision that temporarily halted enforcement of a ruling requiring Apple to loosen certain App Store rules while it seeks Supreme Court review. This decision comes ahead of Apple's Supreme Court appeal. Following the court's decision, Epic Games filed two motions, one claiming that Apple's request for a stay was a delay tactic to prevent the court from establishing permanent limits on Apple's ability to charge junk fees on third-party payments. Apple argued that maintaining the stay would avoid unnecessary lower court proceedings while the Supreme Court reviews the ruling. However, the court agreed with Epic's argument that even if the Supreme court agrees with Apple's arguments, there would still be further proceedings on remand on the question of commission.
