SD Supreme Court weighs legality of mid-lease rule change at survival bunker community

Daniel Sindorf, a survival bunker community near Edgemont, South Dakota, has been in court challenging the legality of a mid-lease rule change at his landlord, Vivos XPoint Investment Group, which attempted to evict him for allegedly brandishing and pointing a firearm at a fellow resident. Sindorf argued that the lease's clause allowing Vivos to change rules at any time was unenforceable, and he won initially. However, a circuit court judge agreed that the rule change was unilateral and gave Sindorf "no recourse." The South Dakota Supreme Court is hearing oral arguments during its spring term. If the court rules to be valid, it would give Sindorf the right to dispute the dispute or renegotiate the lease.
