Judge scolds Live Nation and Justice Department for secret settlement talks

A federal judge has publicly criticized the Justice Department and Live Nation for secretly negotiating a settlement to resolve allegations that ticket giant operated as a monopoly. Judge Arun Subramanian was blindsided by the deal, which the companies claim will benefit consumers by providing more options and lowering prices. Over 30 state attorneys general are also part of the case against Live Nation, but have not yet decided whether to join the settlement. Some states have asked for a mistrial and at least 60 days to recast their case. Subramanan ordered the head of the DOJ’s antitrust division, Omar Assefi, and CEO Michael Rapino to answer questions about the deal. He also admonished the states for not being prepared for the possibility of a deal. The judge ruled that the parties' conduct was inconsistent with traditions and principles in this courthouse.
