The new state law, House Bill 2844, allows for a statewide operating permit for food trucks in Texas, to be created to apply to any food truck in the state. Currently, food truck owners must pay each city's permitting fees to operate in another city or county, which can cost several hundreds of dollars per jurisdiction. The Department of State Health Services (DSHS) will create a statewide permit that will apply to all food truck operators in Texas. The new law allows for food truck licenses in three categories, with the lowest tier for prepackaged foods and the highest for cooking food in their trucks. The state estimates it will license about 19,000 food trucks statewide. However, some cities and counties fear they may lose control of how their mobile food trucks operate in their locations. The bill also creates a public database that will include a list of food truck drivers statewide and their inspection results, public complaints, and will penalize them if they fail to meet licensing requirements.
