Three suspects are facing felony assault charges for an unprovoked beating outside a San Jose restaurant, where they hurled anti-Semitic slurs before attacking two elderly Jewish diners. The attack was described as a "hate crime" by an internal police report. The suspects, who also hurled antisemitic slurs, turned themselves in to the San Jose Police Department and were charged with felony assault. However, Santa Clara DA Jeff Rosen has declined to bring hate crime charges against the trio, stating that such charges require proof that the suspect was motivated by hate. The assault was captured on video outside the restaurant Augustine. The three suspects had a reputation for antisemitism and were known each other through the Assyrian community.
