Lawsuit over fee to enter Lower Manhattan could be headed to mediation

New Jersey and New York may go to mediation over the congestion pricing program that charges drivers $9 to enter Lower Manhattan. Gov. Mikie Sherrill's administration has requested a 30-day time-out from a federal court to allow for discussions with New York. This comes after a federal judge ruled in favor of New York's $9 congestion-pricing toll. A video status conference is scheduled for April 21 by U.S. Court of International Trade Judge Leo M. Gordon. The lawsuit was brought by Gov. Phil Murphy in July 2023 and is challenging the Federal Highway Administration’s approval, which New Jersey is challenging in federal court. The issue of congestion pricing and the effects of increased air pollution has also been raised.
