A federal judge in Oregon has ruled that Health and Human Services Secretary Robert F. Kennedy Jr.’s attempt to impose far-reaching restrictions on gender-affirming care for minors in the US is unlawful and unconstitutional. The "Kennedy Declaration" was vacated by U.S. District Judge Mustafa T. Kasubhai, who found it exceeded the administration's authority, violated federal rulemaking requirements, and conflicted with existing law. The court also permanently enjoined the federal government from enforcing the policy against providers in the plaintiff states. The ruling was seen as a sharp rebuke to the Trump administration's aggressive efforts to reshape transgender health care policy through executive action alone. LGBTQ+ advocates praised the decision, with Equality California Executive Director Tony Hoang calling it "dangerous and unlawful" and "cruelty". The ruling restores the status quo in the states where providers can continue offering care without the threat of losing federal funding.
