East Bay truck driver awarded $5M in workplace harassment suit

A jury has awarded Joseph Sample Jr., a disabled Black man who worked as a ready-mix truck driver for construction materials company Cemex, $5 million as compensation for years of racist and hostile harassment in the workplace. Sample alleged that co-workers would often call him the "n-word," "monkey," and other offensive slurs related to his disability. His attorney, Adanté Pointer, claimed that CemEx knew of the abuse and failed to protect him. Both Sample and his former co-worker, Thomas Milano, both claimed they reported the harassment but were never interviewed by human resources. The trial began March 23 and ended March 31 with a nine-member jury finding in favor of Sample.
