Legal experts from Fox News legal analyst Gregg Jarrett and George Washington University law professor Jonathan Turley have stated that Democratic California Rep. Eric Swalwell will not succeed in stopping the FBI from releasing files regarding his alleged affair with Christine Fang, a suspected Chinese spy. The experts believe this argument will not hold well with courts as long as the government complies with existing laws like the Privacy Act and removes material that is protected from release. They also noted that while a sitting congressman, Swalway's status as a sitting representative does not have a unique privacy protection from federal investigations by the FBI, his file can be released under a broad exception to the PrivacyAct if it is in the public interest and directly impacts his ability to perform his job.
