Kansas anti-trans law targets IDs and birth certificates — and the right to vote

The latest anti-transgender law in Kansas has been passed by the state, which also includes a sweeping bathroom ban and a first in the nation, requires any Kansas birth certificate or driver’s license that reflects a transgender person’�s gender identity to be invalidated and revoked. The law also requires transgender Kansans to surrender their now-invalid driver”s license to the state before receiving a replacement, which will only reflect their sex at birth. This move is particularly concerning as Kansas has one of the strictest voter ID laws in the country, which requires voters to present a state-issued, unexpired, photo ID to cast a ballot. However, if a voter cannot provide an ID that meets these requirements, they must cast a provisional ballot, which can only be counted if submitted to their county elections office by the following day following the election. There are no measures offered to ensure that transgender voters will not be turned away by confused poll workers due to confusion over their gender marker, or when they must produce a valid ID to be allowed to vote. The bill was vetoed by Gov. Laura Kelly, but critics argue that it is poorly drafted, creating many unanswered questions about its implementation.
