The U.S. 8th Circuit Court of Appeals has ruled that the Department of Homeland Security can detain illegal immigrants without bond. This decision was made in the case of illegal immigrant Joaquin Herrera Avila, who was detained without bond in 2025. All three judges on the panel were Republican appointees, one by President George W. Bush and two by President Donald Trump. The majority rejected Avilas' claim that being in the United States was the same as being legally authorized to enter the country. The ruling overturns a district court ruling that Avilan could not be held without bond under the relevant statute.
