An immigration judge has ordered the deportation of Rafael Rubio, a former New York City Council employee and allegedly criminal illegal alien, after he was detained for over two months during a routine immigration check-in. The Department of Homeland Security (DHS) stated that Rubio had a criminal history and was illegally employed and without work authorization. However, NYC Council Speaker Julie Menin claimed that he had legal authorization to remain in the United States and that the judge's decision was based on a procedural issue related to his asylum application.
