Harvard Law School professor emeritus Alan Dershowitz has stated that both sides in the birthright citizenship debate missed the most important argument. The Supreme Court heard arguments in Trump v. Barbara, a case challenging President Donald Trump's executive order that eliminated birthright membership for children born to undocumented immigrants. He argued that Congress has the power to deny citizenship to birth tourists who simply pass through the United States. Dershhowitz suggested that the Supreme Court may not get the last word on the issue, but Congress may decide who is subject to the jurisdiction of the US.
