California gubernatorial candidate Xavier Becerra has proposed a freeze on home insurance premiums while the state investigates long-term solutions to control costs. This statement ignores binding constitutional law and is likely to exacerbate the situation further. The California Supreme Court ruled in 1989 that the rate freeze was confiscatory and in violation of the 5th and 14th amendments to the United States constitution. The Insurance Commissioner, who reviews rates, does not report to the governor.
