The Department of Justice had appealed the initial ruling, arguing that the subpoenas were not part of a criminal investigation but a tool to target Fed Chair Jerome Powell. The government has the power to appeal the decision to a higher court, potentially delaying confirmation of its successor, Kevin Warsh.
