The U.S. Immigration and Customs Enforcement (ICE) has arrested an illegal alien from the Dominican Republic, Bryan Rafael Gomez, charged with assault and battery. Despite Worcester Police Department's reluctance to cooperate with ICE, the detainer was honored and ICE Boston was able to arrest Gomez after his release on $500 bail. While ICE planned to keep Gomez in custody until his deportation order was granted, a judge appointed by former President Joe Biden, Judge Melissa DuBose, a black lesbian who served as a member of the Committee on Racial and Ethnic Fairness in Rhode Island Courts, ruled that Gomez was not subject to mandatory detention due to an international arrest warrant for homicide in his name. DuBOSE argued that the legal authority under which ICE held him, which is intended for migrants captured at the border, did not apply to Gomez because he had been arrested by local police.
