EDITORIAL: There’s no constitutional right to sodas paid for by SNAP
Published on March 21, 2026.
The National Center for Law and Economic Justice has sued the U.S. Department of Agriculture (DPA), which runs the Supplemental Nutrition Assistance Program (SNP), for not allowing taxpayers to spend their own money on soda. The study revealed that soft drinks were the top item purchased by SNAP households, making up 5.4% of all expenditures compared to 4% in non-SNAP households. The group objects to waivers from the USDA limiting the junk food purchased by more than 20 states. The National Center also objects to similar waivers in Colorado, Iowa, Nebraska, Tennessee and West Virginia. The article concludes that the unalienable rights listed in the Declaration of Independence don't include life, liberty and soda paid for by someone else.
