Judge says ‘nein’ to German tourist lawsuit over ‘spicy’ tacos: suit

A Manhattan federal judge has denied a $100,000 lawsuit by a German tourist, Faycal Manz, who claimed he suffered "diarrhea, nausea" and "mouth/tongue blisters" after consuming three tacos at the Los Tacos No. 1 in August 2024. Manz claimed that the spicy salsa was a big shock to him, compared to his regular diet of spicy food. Despite admitting he never asked staff about the heat, Manz argued that the restaurant failed to warn him of any potential harm. The judge dismissed Manz's claim, stating that while his pulse may have spiked while he expanded his palette, his legal standing was flatlining, especially since the "dangerous" green salsa was labeled "medium" in online photos.
