Utah lawmaker, Rep. Jordan Teuscher, has proposed a constitutional court as a solution to the state's court system facing backlash. The bill, HB392, allows for a three-judge panel for constitutional challenges to be heard instead of a single judge. This would streamline the litigation process and prevent forum shopping for both parties. If the state’s recently enacted three-judicial panel system is struck down by the courts, a trigger law in HB366 would automatically create a new constitutional court. However, some argue this is branch overreach and that the constitution allows the Legislature to create other courts.
